These General Terms and Conditions (hereinafter: "Terms") govern the conditions of use of the Meliovate platform operated by AGENCITY VIDEO MARKETING S.R.L. (hereinafter: "Provider").

The Terms apply to every natural and legal person who uses the Meliovate platform — any of its functions, interfaces, applications or associated hardware products — (hereinafter: "User").

By commencing use of the platform — through registration, login or use of any service — the User expressly accepts all provisions of these Terms. Anyone who does not accept the Terms is not authorised to use the platform.

The Provider reserves the right to amend these Terms unilaterally. Amended terms enter into force 30 days after publication on the website. The User's continued use of the platform after the amended terms enter into force constitutes acceptance of the amended terms.

Meliovate is the world's first domain-specific beekeeping intelligence platform, providing beekeeping management software, IoT hardware devices, educational content and beekeeper community features in a single integrated system.

The platform includes the following main services:

• Digital hive log and record-keeping system
• AI-driven stimulation strategies and weekly schedules
• 16-day weather-synchronised dosing planning
• Integration of IoT hardware devices (MSM-1, MSC-1, MIS-1, MHS-1, MHB-1, MWM-1, MSL-1, MCS-1) and real-time monitoring
• Meliovate Academy — structured video courses, interactive lessons, certificates
• Beekeeper community platform, separate per language, with groups, chat function and notification system
• Stripe-based secure payment system

The Provider is entitled to modify, expand or reduce platform functions, interfaces and content without prior notice, provided this does not adversely affect functions paid for by Users with a valid subscription.

Full use of the Meliovate platform requires registration. During registration the User must provide accurate, correct and up-to-date information.

The User is responsible for keeping the password associated with their account confidential. The User is responsible for all activities performed with the password. In case of unauthorised access, the User must immediately notify the Provider at hello@meliovate.io.

The Provider is entitled to suspend or delete the User's account with immediate effect if:

• The User violates these Terms;
• The information provided is false or misleading;
• The User uses the platform for illegal purposes, to disturb other Users or to jeopardise system integrity;
• A court or authority orders the Provider to do so.

A natural person is only entitled to create and maintain one user account. Maintaining multiple accounts simultaneously is only possible with prior written permission.

The Meliovate platform is available in the following subscription plans:

Prices are in USD and include VAT. Pro pricing may vary by region. The Provider reserves the right to modify subscription fees; current prices are always available on the website. For existing subscribers, price increases apply from the next renewal cycle, of which the Provider will notify the User at least 30 days in advance.

Payment is made through the Stripe payment system by bank card (Visa, Mastercard, American Express). The Provider does not store card data; these are exclusively handled by Stripe with PCI-DSS certification.

The monthly Pro subscription automatically renews at the end of each billing period, unless the User cancels the subscription at least 24 hours before renewal in the account settings menu.

In case of payment failure, the Provider attempts re-billing for 3 working days. After this the account is automatically downgraded to Free plan; data is retained.

Based on legal obligations, the Provider issues an invoice under Romanian law through the Oblio billing system. The invoice is sent to the registered email address.

The Meliovate platform offers the following IoT hardware devices as add-ons:

• MSM-1 — Stimulation Module (automatic feeding system)
• MSC-1 — Sense Core (temperature and humidity ~every 3–4 hours; hive sound pattern via microphone once daily)
• MIS-1 — Intelligent Scale (smart hive scale)
• MHS-1 — Heating System (smart hive heater)
• MHB-1 — Hive Bottom (smart hive bottom with built-in heating element and temperature sensor; works with MHS-1 heating controller)
• MWM-1 — Weather Mini (local weather station)
• MSL-1 — Syrup Level (syrup tank level sensor)
• MCS-1 — Control System (NFC hive identification)

Hardware products are sold under a separate purchase agreement. Warranty terms and service procedures are defined in the documentation enclosed with each product. The Provider accepts liability for software defects; physical damage, misuse or force majeure are not covered by the warranty.

All hardware devices run Meliovate OS. Without the platform, devices cannot be programmed and statistics and feedback are not available. Manual start and stop is possible with a Free account; automatic scheduling, intelligent strategies and full functionality are exclusively available with an active Pro subscription.

The Meliovate platform — including its software, source code, algorithms, databases, visual elements, trademarks, logo, educational materials and all other content — is the exclusive intellectual property of AGENCITY VIDEO MARKETING S.R.L. and is subject to copyright, trademark and other intellectual property protection laws.

The User may use the platform solely for personal, non-commercial purposes within the framework of these Terms. Prohibited:

• Reverse engineering, copying, modifying or creating derivative works from platform software;
• Transmitting, selling or publishing platform content to third parties without permission;
• Using the Meliovate trademark, logo or trade name without prior written permission of the Provider.

Own content uploaded by the User to the platform (hive data, log entries, photos) remains the User's property; the Provider processes it only to the extent necessary for providing the service.

The Provider processes Users' personal data in accordance with the European Union's General Data Protection Regulation (GDPR — Regulation 2016/679/EU) and Romanian data protection legislation.

Detailed information on the scope, purpose, legal basis, retention period of processed data and User rights (access, rectification, erasure, restriction, portability, objection) is contained in the Privacy Policy, available on the website.

All sensitive data on the platform is protected with AES-256 encryption. The Provider does not share Users' personal data with third parties, except:

• To processors necessary for providing the service (e.g. Stripe, server hosting) under data processing agreements;
• In case of legal obligation or court/authority request.

The Meliovate platform is a SaaS and IoT service provided "as is". The Provider warrants that the platform operates according to its published specifications during the subscription period, but does not accept liability for:

• Service outage due to force majeure (natural disaster, power failure, cyberattack, pandemic);
• Damage resulting from failure of third-party services (Open-Meteo weather API, Stripe, server hosting);
• Damage arising from User negligence, misuse or security failure;
• Loss of profit, indirect damage or consequential damage.

The Provider's direct liability is in all cases limited to the amount of the subscription fee actually paid by the User in the relevant billing period.

The platform does not constitute veterinary, plant protection or regulatory advice; recommendations generated by Meli AI and algorithms are informational and do not replace professional judgment.

The User may cancel the subscription at any time without reason in the account settings menu. Cancellation takes effect at the end of the current billing period; the fee already paid is not refunded and the User has access to functions until the end of the period.

The Free plan User may delete their account at any time; upon deletion all data is permanently and irrecoverably deleted.

The Provider is entitled to terminate the contract with immediate effect if the User seriously violates these Terms, or if a court/authority order requires it. In this case no refund of the subscription fee is possible.

The Provider will notify Users of planned platform downtime at least 14 days in advance, and immediately in case of unforeseeable events. In case of prolonged service suspension, Pro Users are entitled to a pro-rata refund for the affected period.

These Terms and the legal relationships arising from them are governed by Romanian law.

Disputes between the parties are first attempted to be resolved by negotiation. The User may submit a complaint to hello@meliovate.io; the Provider will respond in writing within 15 working days.

If negotiated resolution does not succeed within 30 days, the parties submit to the exclusive jurisdiction of the Romanian court competent at the Provider's registered address.

Consumers using the service from the European Union may also use the EU Online Dispute Resolution Platform (https://ec.europa.eu/consumers/odr).

These Terms — together with the associated Privacy Policy — constitute the entire agreement between the User and the Provider regarding the use of the Meliovate platform and supersede all prior agreements on the same subject.

If any provision of the Terms is invalid or unenforceable, this does not affect the validity of the other provisions; the invalid part shall be replaced by a provision compliant with the law and closest to the parties' intent.
